Why is my license revoked?

 

The most common reasons that your license is revoked are that you missed court, that you have unpaid court costs and fines, that you have too many points on your driver’s license, that you were convicted of reckless driving and speeding in the same twelve month period, or that your license was revoked because you were charged with or were convicted of DWI.

You can find out why your license is revoked by ordering a driving record online from the NC DMV, or you can go to the local DMV branch and ask why your license is revoked. We can pull a driving record for you for a small fee if you are unable to do it yourself.

Once you have your driving record, we can look through it and tell you why your license is revoked and what you need to do to get your license back. We can generally help you get your license back if you missed court or didn’t pay your fines. We can sometimes help if your license was revoked for too many points or for being convicted of reckless driving and speeding in the same twelve month period. We can only help very rarely if your license was revoked for DWI.


My license is revoked only because I missed court.

 

If you missed court in a county that we serve, we can get your case added back on to the docket for you and help you resolve your case. Once all of your cases have been added back on to the docket, they have been resolved in court, and you have paid any court costs and fines that are due, then you are generally eligible for reinstatement. You have to pay a reinstatement fee to the DMV in order to get your license back.


My license is revoked only because I have unpaid fees and court costs.

 

In order to get your license back, all of your court costs and fines have to be paid. Depending on your financial situation, we may be able to file a motion to the court to have some or all of your court costs remitted. You would not have to pay any costs or fees that have been remitted by the Court. Once all of your unpaid court costs have either been paid or remitted, then you would generally be eligible for reinstatement, You have to pay a reinstatement fee to the DMV in order to get your license back.


My license is revoked for too many points or for reckless driving.

 

These cases are among the more complex cases that we handle. In order to get you into a position where you are eligible for reinstatement, generally we have to file a Motion for Appropriate Relief (“MAR”). Considerable work is required to draft and successfully argue an MAR, so our fees are usually higher in these kinds of cases.

An MAR can only be filed for certain statutory reasons. If your case fits the criteria for filing an MAR, then we can reopen a case that you have already plead guilty to and potentially have it reduced or changed to a different charge. If we are successful, this usually reduces the number of driver’s license points that you have, or changes the case you plead guilty to to one that doesn’t require the DMV to revoke your driver’s license.

You may have to pay additional fines or court costs if we successfully argue an MAR on your behalf.

If the MAR resolves the issue that caused your driver’s license to be revoked, you would still have to pay a reinstatement fee to the DMV to get your license back.


Why can’t you help if my license is revoked for DWI?

 

If your license is revoked for a DWI conviction, then there is little we can do to help. There are actions that you are required to take in order to be eligible for reinstatement after you have been convicted of DWI. We cannot change those requirements or help you have those requirements waived.

Generally, the only thing that we can do is help you get a Limited Driving Privilege if you are eligible for one.


How much does it cost?

 

Our fee varies with the complexity of your particular case, but generally our fee starts at $250.00 per county that you have unresolved issues in for the least complex cases. More complex cases, such as one requiring a Motion for Appropriate Relief, generally start at $500.00 per county. If you have issues across multiple counties, we can work with you one county at a time so that you don’t have to pay an enormous legal fee just to get started.
